The Department of Homeland Security has finalized new EB-5 filing fees that more than double the price of an investor petition, raising the Form I-526 fee from $3,675 to $7,615 and the regional center version, Form I-526E, to $7,850, under a Final ruleThe version of a federal regulation that an agency publishes in the Federal Register after reviewing public comments on a proposed rule. The rule also creates a new Form I-527 priced at $10,330 and lowers a few regional center fees. It takes effect 60 days after publication, and any filing postmarked on or after that date must include the new amounts.

The I-526 and initial I-526E figures include a $75 EB-5 technology fee. Form I-527 is a new form that lets certain investors who filed before the 2022 EB-5 reforms amend their petitions after a regional center is terminated or a business is debarred.

The EB-5 Integrity Fund fees rise about 10 percent to reflect inflation from 2022 to 2025. The investor fee goes from $1,000 to $1,100. Regional centers with 20 or fewer investors pay $11,000 instead of $10,000, and larger ones pay $22,000 instead of $20,000.
Why the fees changed
A January 2024 rule had set the I-526 fee at $11,160. On November 12, 2025, a federal court in Colorado stayed those EB-5 increases in Moody v. Noem, finding that the EB-5 Reform and Integrity Act of 2022 barred DHS from adjusting EB-5 fees in that rule. DHS says it believes the decision is wrong but has followed it, and USCIS returned to the pre-2024 fees that appear in the tables above as current.
DHS proposed a new schedule in October 2025, with the I-526 at $9,625. The final figures are lower than that proposal for most investor forms and higher for regional center applications. DHS attributes the changes mainly to updated cost and workload estimates, and it received 28 comment submissions.
The agency says EB-5 processing costs about $105 million a year against roughly $56.6 million in revenue at current fees, a gap of about $48.4 million the new fees are meant to close. It estimates the rule affects about 16,600 EB-5 filings a year and raises form fees by about 70.7 percent on a weighted average.
Some commenters asked for lower fees for smaller investors. DHS declined to adopt tiers and said the fees are small next to the $800,000 or $1.05 million investment, a range covered in EB-5 investment amounts. What the rule does not cover
A separate proposed rule published July 2 would implement the reform act’s integrity provisions and automatic revocation of petitions. It is not part of this fee rule. The fee rule notes that the regional center program is authorized through September 30, 2027, and says its analysis assumes Congress will extend it.
