What DHS said about Ukraine and Sudan TPS

DHS said enrolled nationals will be able to live and work in the United States “for the time being” and will “retain protection.” It said final decisions will “be made at the appropriate time.” The report did not name a spokesperson. As of March 2025, more than 100,000 Ukrainians and roughly 1,800 Sudanese nationals held TPS, CBS reported.

Both designations were set to end on October 19, 2026, as covered in our earlier report.

What the TPS statute says when there is no decision

Under the TPS statute, DHS must review conditions in the country at least 60 days before a designation ends. If the Secretary does not determine that the country no longer meets the conditions, the designation is extended for six months. Immigration Analytics reads that provision to mean both designations now run through April 19, 2027. DHS has not cited that provision or that date.

What has not been published

According to Immigration Analytics, DHS has issued no Federal Register notice and no document employers can use for Form I-9 or E-Verify purposes. The outlet also reported that the USCIS Ukraine TPS page still listed October 19 as the end date when it published.

CBS reported that DHS has taken a similar holding pattern for El Salvador since its September 9 end date. See our report on Salvadoran TPS holders, and for how designations, terminations and work permits fit together, see our explainer on TPS updates. We will update this article when DHS publishes a decision.
