Temporary employment

A general employer-sponsored temporary-work journey. The applicable visa category controls the details.

Before you start

Key decisions

  • Which classification matches the job and employer relationship
  • Whether the case is cap-subject or exempt where relevant
  • Consular processing, change of status or extension of stay
  • Whether a job change requires a new petition before work begins

What to prepare

  • Employer petition package
  • Role and qualification evidence
  • Labor-condition or labor-certification material when required
  • Approval notice and status records
  • Dependent documentation if family members will accompany

Stage by stage

  1. Identify the employment category

Match the role and qualifications to the requirements of the relevant classification.

    Temporary worker categories
  2. Prepare the employer petition

The employer or qualifying petitioner checks the required evidence, labor conditions and any applicable selection process.

    USCIS forms
  3. Obtain the required approval and admission

Follow the applicable change-of-status, consular visa or admission procedure. Petition approval is not the same as admission.

  4. Maintain authorized employment

Check the approved employer, role, validity period and rules for changes or extensions.

    USCIS guidance
  5. Plan any next status or residence step separately

A temporary work visa is not itself permanent residence. Review any separate immigrant petition and visa-number requirements.

Common points to watch

  • Petition approval and lawful status are separate questions
  • Employment is often limited to the approved employer, role and dates
  • A material job or employer change may require a new filing
  • Plan extensions and travel before the current validity period ends
